Terms of use

These terms govern access to and use of the TRANSBERTH platform by provisioned users. Where a signed agreement exists between the operator and a client organisation, that agreement takes precedence over these terms.

1. What the platform does

The platform receives documents submitted for a ship-to-ship LNG transfer, presents the values read from them against the applicable requirements, records clarifications between the parties, and holds the record of what a reviewer decided. It produces analysis and evidence.

2. Decisions and responsibility

The platform provides analysis and evidence to support a review. It does not grant, and must not be treated as granting, acceptance or clearance for any transfer. Acceptance and clearance decisions are made by the authorised person, and the operator of the vessel or terminal remains responsible for those decisions and for the safety of the operation.

A finding, a traffic light or an absence of findings is an input to a professional judgement, never a substitute for one. Nothing in the platform relieves any party of an obligation under its own procedures, its class or flag requirements, the terminal's controlled requirements, or applicable law.

3. Accuracy of submitted information

The analysis reflects the documents submitted. The party submitting a document is responsible for it being current, complete and correct. Where the platform records a value, it records what the document states, at the location stated; it does not verify the document against the physical vessel or terminal.

Where sources conflict, the platform shows the conflict rather than resolving it. Where a value is stated as a range, the range is preserved.

4. Accounts

Accounts are issued by the operator to named individuals. There is no public registration. An account may not be shared, and the account holder is responsible for activity under their credentials. Notify the operator immediately if you believe a password has been compromised. The operator may suspend or withdraw an account, particularly when the holder leaves the organisation it was issued to.

5. Acceptable use

You must not:

  • attempt to access a case, document or record outside your permitted scope;
  • probe, scan or test the security of the platform without the operator's written permission;
  • extract data in bulk, or reuse another party's commercially confidential documents for any purpose other than the review they were submitted for;
  • upload malicious content, or content you have no right to submit.

6. The record

Review decisions, clarifications, confirmations and case status changes are retained as an append-only audit record and cannot be edited or deleted. By recording an action you accept that it is attributed to you by name and retained. A correction is made by recording a further action, not by removing the earlier one.

7. Availability

The platform is provided on a reasonable-efforts basis and may be unavailable during maintenance or through the failure of a third-party service. [TO CONFIRM] Any service level, support hours or availability commitment agreed with the client. None is offered by these terms.

8. Intellectual property

The platform, its interface and its rule base remain the property of the operator and its licensors. Documents submitted by a client, and the review record created for that client, remain the property of the party that submitted or created them; the operator holds and processes them to provide the review.

9. Liability

To the extent permitted by law, and without limiting liability for death or personal injury caused by negligence or for fraud, the operator is not liable for operational, commercial or consequential loss arising from a decision made by an authorised person, from information contained in a submitted document, or from use of the platform contrary to these terms. [TO CONFIRM] The liability cap, insurance position and indemnity wording, which belong in the signed agreement rather than here, and should be settled by the parties' legal advisers.

10. Changes to these terms

These terms may be updated. Material changes will be notified to provisioned users, and the date at the top of this page reflects the last review.
